More Suits In Curaleaf CBD/THC Switch, With Wrongful Death Action Expected

The wrongful death case involves a 78-year-old Oregon man who died in October

Two more negligence lawsuits were filed this week against Curaleaf in the company’s Oregon CBD/THC-switch debacle, and a Portland attorney said a wrongful death suit is on the way.

The latest suits, filed in U.S. District court in Portland, bring the total to nine, all brought by attorney Michael Fuller.

Fuller said that because the lawsuits involved unique “severe physical injuries,” they will move forward as separate cases. Some will likely be settled in confidential mediation sessions while others are expected to go to trial, he said.

The wrongful death action is expected to be filed as soon as an Oregon state court responds to a petition to appoint a representative for the deceased’s estate, Fuller said.

The case involves a 78-year-old Christmas Valley man who died in October after allegedly using Select CBD drops that mistakenly contained THC in August.

In the prospective suit, Earl Jacobe is said to have experienced “stroke-like symptoms” that forced him “to be life-flighted to the emergency room on two separate occasions.”
