Kentucky Hemp Company Sues Tennessee Over Alcohol-Style Sales Law

Beginning Jan. 1, regulation of hemp will be transferred to the ABC

After years of legislative patchwork on cannabis laws following the 2018 Farm Bill, one Kentucky company said Tennessee’s newest hemp regulations unfairly shut out out-of-state businesses.

Cornbread Hemp filed a lawsuit to keep the approved regulatory framework from taking effect in January. The lawsuit, filed in U.S. District Court for the Middle District of Tennessee Sept. 17, named Tennessee Alcoholic Beverage Commission (ABC) Executive Director Russell Thomas and the commission’s three members, including Chairwoman Ashleigh Roberts.

Beginning Jan. 1, 2026, regulation of the hemp industry will be transferred from the Tennessee Department of Agriculture to the ABC. That means businesses that produce, distribute or sell hemp-derived cannabinoid products will fall under the ABC’s oversight.
