Texas Alcoholic Beverage Commission Adopts Rules To Regulate Hemp-Derived THC Products

The DSHS has started the rulemaking process

The Texas Alcoholic Beverage Commission (TABC) has adopted emergency rules regulating consumable hemp products following an executive order from Texas Gov. Greg Abbott earlier this month.

At Tuesday’s meeting, the TABC approved two new emergency rules that will ban sales of hemp products containing THC to minors and revoke licenses for stores that violate the regulations.

Bars, restaurants and other TABC-licensed establishments are banned from selling these products to anyone under 21. The TABC also said purchase of all THC products will require a valid government-issued photo ID, regardless of the customer’s apparent age.

Abbott directed state agencies to crack down on hemp-derived products and keep them out of the hands of minors after lawmakers failed to reach an agreement on regulation during recent special sessions. The governor vetoed a proposal to ban THC products outright but has pushed for tighter restrictions, particularly on sales to people under 21.
